This Privacy Policy is prepared pursuant to and in accordance with Article 13 of the EU Regulation April 27, 2016, No. 679(for short, hereinafter "GDPR"),on the protection of individuals with regard to the processing of personal dataand on the free movement of such data, in force since May 4, 2016 and definitively applicable directly in all EU countries as of May 25, 2018.
In particular, pursuant to Art. 12, 13 and 14of the GDPR, the company Nichetto Studio AB (for brevity, hereinafter also "NichettoStudio" or "Company"), with registered office in Lillsvängen 33, 129 42 Hägersten, Stockholm, Sweden, inits capacity as Data Controller (or more simply "Data Controller") hereby wishes to provide the user ("Data Subject") with all the necessary information in order to enable him/her to understand how his/her personal data will be processed, in accordance with the legislative provisions of the above-mentioned legislation and the confidentiality obligations provided therein.
1. Purpose and Legal Basis for Processing
Your personal data, both personal and fiscal, acquired even verbally, directly or through our operators, are qualified by lawas personal data.
With reference to these data we inform yout hat:
- data will be processed in connection with contractual requirements and the consequent fulfillment of legal, tax and contractual obligations arising there from as well as to achieve effective management of business relations. Data will be processed in written form and/oron magnetic, electronic or telematic media;
- the provision of the data themselves is obligatory for all that is required by legal, fiscal and contractual obligations, and therefore any refusal to provide them or the subsequent processing may result in the inability of the writer to initiate the same contractual relationships;
- failure to provide, on the other hand, all data that are not attributable to legal, fiscal or contractual obligations will be evaluated on a case-by-case basis by the Owner and will determine the consequent decisions related to the importance of the requested data with respect to the management of the business relationship.
2. Recipients or Categories of Recipients to Whom Personal Data May Be Disclosed
The data will not be disseminated except for legal obligations and may be communicated to third parties, public and/or private entities, duly appointed who work in aid and on behalf of the Data Controller, for whom the communication of data is mandatory or necessary infulfillment of legal obligations, institutional purposes.
Without prejudice to the communications and disclosures made in performance of legal, fiscal and contractual obligations, for the sole purpose of credit protection and the best management of our rights relating to the individual business relationship, your personal data may then be disclosed to other parties or general categories of parties other than the Data Controller, such as, but not limited to, credit institutions, debt collection companies, credit insurance companies, business information companies, professionals and consultants, and companies operating in the relevant sector.
3. Possible Transfer of Personal Data to a Third Country Outside The EU
There are no plans to transfer data outside the EU or to international organizations. In any case where the need arises, the Controller will check whether or not there is an EU Commission adequacy decision ensuring an adequate level of data protection.
4. Personal Data Retention Period and Criteria Used
The data will be kept in a form that allows the identification of the data subjects for a period of time not exceeding the achievement of the purposes of the processing, consistent with other legal obligations. Therefore, we would like to inform you that, in accordance with the principles of lawfulness, purpose limitation and data minimization, pursuant to Article 5 of the GDPR, the retention period of your personal datails:
- established for a period of time not exceeding the performance of the services provided;
- established for a period of time not exceeding the fulfillment of the purposes for which they are collected andprocessed and in compliance with the mandatory time limits prescribed by law.
5. Rights of the Data Subject
Pursuant to Articles 15 et seq. of EU Regulation No. 679/2016, the Controller informs you of the following rights:
a) The Data Subject has the right to obtain information on the origin ofpersonal data, the purposes and methods of processing, the logic applied incases of processing carried out with the aid of electronic instruments;
b) Right of access, rectification, cancellation, restriction, opposition;
The Data Subject may access his or her data at any time, request rectification if incorrect, request deletion of overabundant data except those required by law from the Data Controller, and/or limit data access to certain authorized figures.
c) Right to data portability and right to withdraw consent in any;
The Data Subject has the right to receive in a structured, commonly used and machine-readable format the personal data concerning him or her provided to a data controller and has the right to transmit such data to another data controller without hindrance, exclusively in the cases provided for in Article 20 of the GDPR.
d) Right to withdraw consent at any time;
The Data Subject may revoke the consent at any time, without prejudice to the obligation of the Data Controller to continue to hold the personal data subject to this processing where this is necessary to comply with the prescribed legal obligations and/or for the performance of a task of public interest or related to the exercise ofpublic authority.
e) Right to file a complaint with a data protection authority (Art. 77 GDPR).
6. Profiling and/or Automated Decision-Making Activities
No profiling activities will be carried out on the Data Subject and, in any case, any form of automated processing of personal data consisting of the use of such data relating to a natural person, in particular to analyze or predict aspects concerning economic situation, health, personal preferences, interests, reliability, behavior, location or movements.
